TERMS AND CONDITIONS OF USE (TCU) – v18022025
- Purpose
These Terms and Conditions of Use (TCU) govern access to and use of the website www.a-de-se.fr (hereinafter referred to as “the Site”). By using the Site, you unconditionally accept the TCU.
- Access and Use of the Site
Access Conditions: Access to the Site is reserved for adults or those with permission from their legal representative.
User Obligations: You agree to provide accurate information when registering and to comply with applicable laws.
- Products and Services
The descriptions and prices of the products are displayed on the Site. Prices are in euros (€), including taxes, unless otherwise specified.
The company reserves the right to modify products, prices, or conditions at any time.
- Orders on the a-de-se.fr Site
An order on the a-de-se.fr site involves the following sequence:
- Selection of the product(s) to be ordered (including size and color) on the “product” pages of the site.
- Verification of the items to be ordered on the “order basket” page.
- Selection of the delivery method (choice of carrier, delivery method, and delivery location).
- Validation of the basket.
- Entry of personal data necessary for account creation and delivery.
- Selection of the payment method (credit cards or PayPal for immediate or 4X installment payments with no fees).
- Secure entry and validation of the selected payment method via our partner CIC Monetico.
- Order confirmation.
- Order preparation by our logistics partner.
- Delivery and invoice sent by email.
Specific Case of Pre-Orders:
Some products not immediately available may be available for pre-order. In this case, the mention “available for pre-order” will be clearly displayed on the “product” page describing the product. A pre-order is made in the same way as a standard order, including payment. The product will be shipped automatically by A.de.S.E & Associés’ logistics partner as soon as it is received at the logistics site. The customer will automatically be informed when their pre-order is in the process of delivery.
- Right of Withdrawal
In accordance with Article L221-18 of the French Consumer Code, customers have a period of 14 days to exercise their right of withdrawal, except for customized goods (e.g., custom shirts).
- Warranty and Liability
Legal Warranty: The products sold benefit from the legal warranty of conformity and hidden defects.
Liability: The company cannot be held liable for Site interruptions or indirect damages.
- Intellectual Property
The entire site, owned by A.de.S.E & Associés, is a work protected by international conventions and current intellectual property laws, including trademarks, copyrights, and unfair competition laws.
7.1 Trademarks and Logos
In general, the brands, logos, company names and other distinctive signs and property or intellectual property rights arising from the elements of the Site (hereinafter “the Brands”) remain the full and entire property of A.de.S.E & Associés. As an exception to the above:
- the Antoine de Saint Exupéry® brand is the property of the Société Pour L’Oeuvre et la Mémoire d’Antoine de Saint Exupéry (hereinafter “POMASE”)
- the information and brands of A.de.S.E & Associés’ partners specifically listed on this site remain their respective property.
The Customer is therefore required to respect intellectual property rights and may not reproduce or use the Brands appearing on the Site and on the Products, in any way whatsoever, or register a brand that would be detrimental to A.de.S.E & Associés and/or POMASE.
Any use, reproduction, imitation, modification, or deletion, in whole or in part, of the Trademarks, without prior written authorization from their owner, is strictly prohibited and constitutes counterfeiting punishable under Articles L.713-2 and following of the French Intellectual Property Code.
7.2 Copyright-Protected Content
All content on the Site (texts, images, videos, graphics, photographs, designs, illustrations, etc.) are protected by copyright, in accordance with Articles L.111-1 et seq. of the Intellectual Property Code. These contents are the exclusive property of A.de.S.E. & Associés, unless explicitly stated otherwise. In particular, POMASE holds the rights associated with the content from the work of Antoine de Saint Exupéry.
Any reproduction, representation, modification, distribution or exploitation of these contents, in any way whatsoever, without express prior authorization, is prohibited and exposes the offender to civil and/or criminal prosecution.
7.3 Copyright of Photographs
The photographs of products and any other visuals on the Site are protected by copyright.
It is prohibited to copy, use for commercial purposes, or share them without prior written authorization from A.de.S.E & Associés.
7.4 User-Submitted Content
If you submit content (comments, reviews, photos, etc.) on the Site, you guarantee that this content does not violate the rights of third parties (including copyrights and image rights).
